BUILDING USAGE RULES, REGULATIONS, & POLICIES

GENERAL

All persons and/or groups using our facilities are expected to exercise reasonable care and judgement in such use in order to prevent defacement, damage, or breakage. The persons signing the application for use shall be responsible for paying the costs incurred by the Buffalo Dream Center in cleaning, repairing, or replacing any part of the building or its furnishings and equipment which in the judgement of the Buffalo Dream Center’s building manager has been carelessly or irresponsibly subjected to more than normal wear and tear by the persons or group involved.

PAYMENTS

All payments for events, building usage, and recurring rent must be paid in a timely manner. Deposits must be paid at the time of application. The rental fee must be paid within one week before the event occurs. Otherwise, the Buffalo Dream Center reserves the right to revoke the organization/individual’s building usage.

ROOM SET-UPS

All rooms have been designated with a standard room set up. There will be no set up changes made by our staff. You are welcome to change the set up, but must change it back at the end of the event.

KITCHEN

The kitchen is OFF LIMITS to every group.

ELEVATOR

The Buffalo Dream Center has an elevator in order to make the building handicap accessible. Children under the age of 12 may only use the elevator when accompanied by an adult. Persons and groups using the building should use the stairs when possible, unless moving food and larger items between floors. The elevator does not go to the second floor unless prior arrangements are made. In the event that abusive use of the elevator is observed by staff of the Buffalo Dream Center, it will be turned off immediately.

SMOKING POLICY

All members of the group using the Buffalo Dream Center shall abide at all times by a “no smoking” rule in all parts of the building, including the corridors, inner courtyard, and restrooms. Violation of this rule is sufficient grounds for a staff member of the Buffalo Dream Center to immediately withdraw any group’s use of the facility and/or to deny use in the future.

ALCOHOL POLICY

The serving, consumption, or use of alcoholic beverages, marijuana, or other narcotics shall not be permitted at any time on the Buffalo Dream Center’s property, including the outdoor property. Violation of this rule is sufficient grounds for a staff member of the Buffalo Dream Center to immediately withdraw any group’s use of the facility and/or to deny use in the future.

SUPERVISION OF CHILDREN & YOUTH

The Buffalo Dream Center expects all users of the facility to follow the following guidelines with respect to children and youth:

No fewer than two adults must be present at all times during any program or event involving children.
These adults must be 18 years of age or older and must be at least 5 years older than the children/youth with whom they are working.
An adult with any record against a minor may not be present during an event for children/youth.
It is preferable that at least one adult present is currently certified in First Aid and CPR, but not required
Absolutely no child under the age of 12 is to use the elevator unattended by an adult.

FOOD AND DRINK

All other food and drinks require approval in advance. It must be mentioned in your application.

DECORATIONS

Decorations may be attached to the walls, doors, and light fixtures with masking tape ONLY. All decorations must be removed immediately and completely following the event.

STARTING & ENDING TIMES

When filling out the room usage application, be sure to include enough time for set up and clean up. You may not show up prior to the agreed upon time and you may not stay longer than the agreed upon time unless arrangements are made prior to the event. It is possible that the room you are using is being used by another group before or after your time.

EMERGENCY SCHEDULING CONFLICTS

The Buffalo Dream Center reserves the right to pre-empt any facility use for its own in cases of emergencies such as funerals. Notice will be given as early as possible.

BICYCLES AND SKATEBOARDS

No bicycles or skateboards are allowed inside the Buffalo Dream Center. Bicycle racks are available outside.

SECURITY

Our church works to maintain a safe and secure environment within the facility, however, no systems are foolproof. We ask that all users pay close attention to personal property and valuables, not leaving them unattended. The Buffalo Dream Center is not responsible for theft or damage to personal property.

CLEANING

In an effort to keep costs as low as possible, all users must clean up after their building usage. In the event the building manager decides you have not adequately cleaned up, the person signing the application will be responsible and your deposits will not be returned

PARKING

Unfortunately the Buffalo Dream Center does not have a parking lot. There is plenty of off street parking in the surrounding neighborhood. Please pay attention to street signs as to where you can park when. Parking on sidewalks, walkways, or any part of the Buffalo Dream Center’s property is prohibited at any time.

AGREEMENT FOR BUILDING USAGE

Now therefore in consideration that the Buffalo Dream Center permits Organization/Individual to use the building as described in the Building Usage Application, Organization/Individual agrees as follows:

To follow all the policies as laid out in the Building Usage Policies. Not following the policies is sufficient grounds for a staff member of the Buffalo Dream Center to terminate any group’s use of the facility immediately and/or to deny use in the future.
All fees, deposits, rent and the otherwise will be paid in a timely manner, as agreed upon by Organization/Individual and the building manager. Failure to do so gives the right to the Buffalo Dream Center to revoke the Organization/Individual’s Building Usage Agreement.
Organization/Individual recognizes that the Buffalo Dream Center is keeping its building usage fees as low as possible to accommodate non-profit groups/individuals who may not be able to afford rental fees otherwise. Keeping this in mind, Organization/Individual agrees to clean up after the event as specified in Building Usage Policies or agrees to pay janitorial fees as decided upon prior to the event by the building manager. In the event the Buffalo Dream Center is not cleaned to the satisfaction of the building manager as specified in the Building Usage Policies, the Organizations/Individual’s security deposit will not be returned and the Organization/Individual will be billed for additional expenses. The Organization/individual realizes this may affect future building usage.
All damage, defacement, breakage, and additional janitorial fees will be paid within 30 days of the event or building usage. Failure to do so gives the right to the Buffalo Dream Center to revoke all future events and building usage by the Organization/Individual.
Organization/Individual hereby release, discharges, and covenants not to sue the Buffalo Dream Center or its administrators, directors, agents, officers, members, volunteers, and employees, from any and all liability, claims, demands, losses, injuries, or damages arising out of Organization/Individual’s use of the building. If any member, guest, invitee, or participant of Organization/Individual makes any claim against the Buffalo Dream Center or its administrators, directors, agents, officers, members, volunteers, or employees, in connection with Organization/Individual’s building usage, Organization/Individual will indemnify, defend and hold the Buffalo Dream Center and its administrators, directors, agents, officers, members, volunteers, or employees harmless from any and all litigation expenses, attorney fees, losses, liability, damages, and costs arising out of such a claim.
Organization represents that it carries standard general liability insurance coverage with a minimum of $1,000,000.00 per occurrence. Upon request, Organization will provide the Buffalo Dream Center with proof of liability insurance, and if requested, will add the Buffalo Dream Center as an additional insured under the Organization’s general liability policy.
In the event that the Organization/Individual does not carry a standard general liability insurance policy, the Organization/individual may be required to sign an additional waiver of liability. Under certain situations, at the discretion of the building manager, each participant from the Organization/Event may be required to sign a waiver of liability.
Organization/Individual hereby consents and authorizes the Buffalo Dream Center to use photographs, video, and other digital media in any and all of the Buffalo Dream Center’s publications for the purposes of advertising building usage and building programs. Organization/ individual irrevocably authorizes the Buffalo Dream Center the right to edit, enhance, or crop any photo, video, and digital media from its organization/event for the specified purposes without prior inspection. Organization/individual understands and agrees all such photos, video, and digital media are property of the Buffalo Dream Center and Organization/individual will receive no compensation for such.
Organization/Individual may not use the Buffalo Dream Center or any of its programs to advertise or promote its own agenda in any newsletter, publication, on social media, or in any other way, other than to share with regards to its participation in an event or program of the Buffalo Dream Center. Organization/Individual may only advertise the Buffalo Dream Center as the location for its event or building usage. Organization/Individual may not list the Buffalo Dream Center as a supporter, collaborator, partner, sponsor, participant, or the like unless prior permission has been granted by the building manager.
Buffalo Dream Center reserves the right to deny Organization/Individual building usage without any explanation prior to approving of the Building Usage Agreement and reserves the right to revoke a Building Usage Agreement in the case of an emergency, or in the case that Organization/Individual does not follow the policies of the agreement. In the case that a Building Usage Agreement is revoked Organization/Individual will receive a letter outlining the explanation for the revocation.
With respect to long-term tenants, the Buffalo Dream Center has the right to revoke a Building Usage Agreement in the event that Building Policies are not followed. In most cases, a 30-day notice will be given. However, in extreme cases such as the use of drugs, alcohol, smoking, and vandalism, the Buffalo Dream Center reserves the right to immediately and permanently revoke building usage and end all leases. Building Usage Agreements for long-term tenants are to be renewed every January for the term of one year. The Buffalo Dream Center reserves the right to not renew a lease without explanation. The tenant will receive at least a 30-day notice. Tenants reserve the right to not renew their lease without explanation. However, if a tenant signs a Building Usage Agreement and breaks it, penalties, as outlined in the Agreement, must be paid. Tenants must give at least a 30-day notice for the non-renewal of the Building Usage Agreement.

Acceptance of Responsibility: *

I agree to be responsible for the conduct of those coming to and participating in the activity or event for which this application is being made, and for any damages beyond normal wear and tear that may occur as a result of this activity or event. I will remove all decorations and signs posted by my group upon the conclusion of the event. I will be responsible to abide by or make certain Organization abides to the points listed in this agreement. I consent to the Release and Indemnity agreement as listed above in point #5. I further agree that the Buffalo Dream Center’s building will be used in accordance with the Building Usage Policies.
